Shawne Merriman is now suing Tila Tequila

San Diego Chargers linebacker Shawne Merriman is now firing back on his former girlfriend Tila Tequila about the "domestic violence" incident which Merriman claims that Tila lied about the true details of the incident and it is an attempt to destroy his career.

According to TMZ, "Merriman isn't suing for defamation though -- instead he's suing for intentional interference with contract and unfair competition as well as trademark infringement ... because Merriman claims she used his famous "Lights Out" logo on her website. Merriman also claims Tila's accusations screwed up a deal to produce a line of T-shirts for Walmart."

The District Attorney didn't found sufficient evidence to charge Merriman after he was arrested last September. The charges was dropped.

A naked Tila Tequila gave a raging rant last month via UStream blaming Shawne Merriman for the "choking" incident.

Reality star Tila Tequila is in her crazy mood as she flaunted herself naked in Ustream and gave a raging rant about everything especially her ex-San Diego Chargers linebacker Shawne Merriman.

Tila said, “People call me an attention whore .. or whatever … but excuse me I’m a grown ass woman and I’m confident in myself …I think a woman’s body is a beautiful thing … that’s why I’m a lesbian … I was born naked … anybody who is against that is gay and in denial.”

To the rescue for her meltdown is her lawyer Cyrus Nownejad, blaming the "domestic violence" incident with ex-BF Shawne Merriman.

DA found insufficient evidence to charge Shawne Merriman; Tila Tequila Bruises Photos Not Enough

Even though there are evidence of bruises on her body after the alleged assault by her boyfriend Shawne Merriman, reality TV star Tila Tequila is definitely frustrated after San Diego District Attorney announced that they didn't found sufficient evidence to charge him.

The San Diego D.A. statement: “After a thorough review of the investigation into the Sept. 6, 2009 incident at the Poway home of Shawne Merriman, our office has determined there is insufficient evidence to prove beyond a reasonable doubt that any crime was committed. The case is now closed.”

Tila claims she was "choked and physically restrained" by Merriman after she tried to leave his residence.

Merriman claims he was trying to stop and protect Tila in leaving his home because she's drunk and he didn't feel it was safe for her to travel.

Tila Tequila accused Shawne Merriman of choking her

Reality TV star Tila Tequila (real name: Tila Nguyen) got into an argument with San Diego Chargers' Shawne Merriman and accused the linebacker of choking her and she was physically restrained by Merriman after she tried to leave his residence.

San Diego Sheriff's deputies responded to a disturbance call at Sage Crest Drive in Poway and arrested Merriman after Tila claimed that she was attacked by him. (3:45 AM., September 5)

Tila Tequila signed a citizen’s arrest at the scene, charging the football star with battery and false imprisonment.

She was transported to Pomerado Hospital while Merriman was taken into custody. His bail was set at $58,000.

UPDATE: According to TMZ, "A lawyer for Merriman denied all charges and says Tila was "extremely inebriated" and that Merriman tried to stop her from leaving the home because he didn't feel it was safe for her to do so."

San Diego Chargers GM A.J. Smith released a statement: "It's disappointing to hear about the issue involving Shawne Merriman. We'll continue to monitor the situation and let the legal process run its course."
